1. Who these terms are between
These terms govern Knit Anywhere ("the service"): the website at anywhere.getknit.app, the ticket issuer there, and the relays and call servers its tickets let the Knit app use. The service is provided by Jeffrey Walter Mixon, a sole proprietor in the United States ("we", "us") to people who support Knit (section 4). You accept these terms when you claim the service, on the page where the claim's button refers to them. If you use the service without supporting Knit, for example through the free key the Knit app makes when you allow it, these terms apply to that use too.
You must be at least 18 years old, or the age of majority where you live, to claim the service as a supporter. The service is not for children under 13, and anyone under 18 may use it only with the permission of a parent or guardian who accepts these terms for them.
2. What the service is
Knit is a free messenger that works phone to phone, without the internet. It is not part of the service, and it works without it; the Knit app has its own privacy policy at getknit.app/privacy. The service gives a phone running Knit a ticket each day that lets it use the relays and call servers we run: to send photos and files over the internet to people who are not nearby, within a daily upload allowance; to show a supporter badge to the people it chats with, if its holder turns the badge on; and, once calls open, to carry a call through our servers when the two phones have no direct path, or every call if its holder turns on Relay all calls.
We set the daily allowance, the largest file a phone may send and how long a relay keeps a file, and each ticket carries the figures that apply that day, which differ between a free key and a supporter's key. We may change them; section 7 says what we do when a change reduces what a supporter's key carries.
The relays and call servers carry only Knit's own traffic. The service is not a VPN or a proxy, and it does not give access to the internet or to any other service.
The relays run Knit Spool, free software licensed under the GNU Affero General Public License v3.0 or later. These terms cover the service we run with it; they do not alter that licence or restrict your right to run Knit Spool, or a call server, yourself.
3. Your key
We hold nothing in your name. The service is provided on a key: a random secret, which the Knit app calls a ticket key, held for one phone ("your key"). A free key is made by the Knit app when you allow it, and only your phone keeps it. A supporter's key is made when you claim it: if you sponsor on GitHub Sponsors, by signing in with GitHub on our claim page; if you support Knit on Ko-fi, by the link we email to the address Ko-fi gives us with your payment. Our site then shows you once a link that hands the key to Knit on your phone. We keep only a fingerprint of the key, so we cannot show the link or the key again. A GitHub sponsor, or a Ko-fi email address, has one supporter's key at a time.
A supporter's key is tied to the first phone that uses it. Knit makes a second key on that phone, which never leaves the phone, and we keep only a fingerprint of it. Another phone that opens the same link is refused. To move Knit Anywhere on your key to a new phone, choose to move it in the Knit app on that phone: a key can move once it has stayed on one phone for a while, and the app shows when. To move it sooner, for example after losing a phone, write to support@getknit.app from the GitHub account or the email address you support Knit with.
Keep the link and the key confidential. The first phone to use them takes the key, and anyone holding them can move it once it may move. If you lose a supporter's key, or believe someone else has it, write to support@getknit.app from the GitHub account or the email address you support Knit with. We will issue a new key in its place, with the same standing, and the old one stops working.
You may not share a key or its tickets with other people, or sell them.
5. Acceptable use
You may not use the service, or let anyone else use your key, to break the law or to help someone else break it. In particular you may not use it to send, store or distribute material that sexually exploits or endangers children, that infringes another person's rights, or that you have no right to distribute; to spread malware or to command it; to send unsolicited bulk messages; to harass, threaten or defraud anyone; to attack, overload or probe our relays, our call servers or other systems; to make keys in bulk, or to get around the daily allowance, the file size limit or any other limit; to interfere with other people's use of the service; or to resell the service or sell access to a key.
You may not claim or use the service if you are in, or ordinarily resident in, a country or territory subject to comprehensive United States sanctions, or if you appear on a United States, EU or UK sanctions list, and you may not use it in breach of United States export control law. Knit Spool is publicly available open-source software; the service is provided from the United States and the European Union and is subject to their laws.
Photos, files and calls are sealed on the phones before they reach our relays and call servers, so we cannot inspect what passes through them. We act on what we can see: patterns of requests and connections that endanger the service, reports about a key or a conversation, and requests from authorities that bind us. Depending on the case we may lower a key's allowance, stop issuing it tickets, suspend it or end it. Where a breach can be put right and we can reach you, we contact you first and give you a reasonable time to do so. Where it cannot — including apparent child sexual abuse material, malware, attacks on the service, fraud, a sanctions breach, or a lawful order — we may suspend or end the key at once and end the agreement. Where we can reach you, we tell you what we did and why, unless the law forbids it.
To report abuse of the service, write to abuse@getknit.app with what you saw and where. We reply to every report and act within what a service that carries sealed traffic allows. Notices of claimed copyright infringement under the Digital Millennium Copyright Act, and notices of illegal content under the EU Digital Services Act, go to the same address, which is also our point of contact for authorities. Because we cannot see or remove an individual message or file, we act on the key, relay room or conversation the notice lets us identify. We end the keys of people who repeatedly infringe.
6. Your content and your data
Photos and files are encrypted on your phone before they reach a relay. The relay stores the sealed copies, which it cannot open, for a limited time and passes them to the phones they are for. Calls are encrypted end to end between the two phones, and a call server that carries one cannot hear it or join it. We do not and cannot read, analyse or moderate what you send. You keep whatever rights you hold in it and are responsible for it.
What we hold, how long we keep it and how it is protected are set out in the privacy policy at anywhere.getknit.app/privacy-policy.
7. Availability, changes and support
We aim to keep the service running, but we do not promise any particular level of uptime, and a call server gets a call through most networks, not all of them. The service is provided as is. We may carry out maintenance, move a relay or a call server to other machines, update the software they run, add features, or change the allowances in section 2. Where a change materially reduces what a supporter's key carries, we will say so at least 30 days in advance on this website and on the GitHub Sponsors and Ko-fi pages, and if you do not accept it you may cancel and we refund the unused part of the month or year.
Support is by email at support@getknit.app, and a person reads it. We do not offer a support response-time commitment.
8. Ending the agreement
You cancel monthly support on the platform you give through, GitHub or Ko-fi. Your key then keeps the service to the end of the month already paid for, and the service on it ends. Cancellation is online and needs no call or letter. Turning the service off in the Knit app, or removing the app, makes your phone forget its key but does not cancel your support. The service on a key from a one-time payment ends when its year does. A free key ends when it has fetched no ticket for 30 days. Questions about a payment or a refund go to us.
We may suspend or end the agreement at once for a breach of section 5 that cannot be put right, where a charge for the service is reversed by your card issuer at your request, or where the law requires it; for any other breach we give you notice and a reasonable time to put it right first, where we can reach you. We may also end the service, or the service on your key, for any other reason on at least 30 days' notice, in which case we refund the unused part of any month or year already paid. If you dispute a payment, write to us first; a chargeback raised without doing so may lead to the key being suspended while it is open. Sections 6, 9, 10 and 11 survive the end of the agreement.
9. Disclaimer, limitation of liability and indemnity
To the fullest extent permitted by law, the service is provided without warranties of any kind, express or implied, including of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that it will be uninterrupted, error-free or secure against every threat, or that any photo, file or call will be delivered.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or in connection with the service; and our total liability for all claims in any twelve-month period is limited to the fees you paid for the service in that period, or fifty United States dollars if you paid less than that. Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.
If a third party makes a claim against us because you broke section 5, or because of what you sent through the service in breach of the law, you will compensate us for the reasonable costs and damages that result, provided we tell you promptly and let you take part in the defence. If you are a consumer, this applies only to losses your breach caused and that were foreseeable.
10. Changes to these terms and general provisions
We may change these terms. We will publish a material change on this website at least 14 days before it takes effect, and say so on the GitHub Sponsors and Ko-fi pages; using the service after that date is acceptance of the new terms, and if you do not accept them you may cancel before then. The current version is always at anywhere.getknit.app/terms-of-service.
These terms, with the platform's terms for the payment, are the entire agreement between us about the service. If a provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these terms without our consent; we may assign them to a successor of the service on notice to you.
11. Governing law and disputes
These terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law rules. Before starting a claim, write to support@getknit.app and give us 30 days to resolve it. The state courts of Santa Cruz County, California, and the United States District Court for the Northern District of California have exclusive jurisdiction over disputes arising from these terms, except that either of us may bring a claim in small claims court. The payment itself is also governed by the terms of the platform you paid on. If you are a consumer in the European Union or the United Kingdom, nothing in this section takes away the protection of the mandatory laws and courts of the country where you live.
